This guide provides essential information to enterprises on applying for an initial issuance of the Permit of Safe Use of Hazardous Chemicals.

Basic requirements
Applicants shall satisfy the conditions for obtaining a Permit of Safe Use of Hazardous Chemicals in accordance with the Implementation Measures for the Permit of Safe Use of Hazardous Chemicals.

The enterprise's site selection, overall layout, storage facilities and safe separation distances shall comply with applicable laws, regulations and relevant national or industry standards and shall ensure production safety.

Newly established enterprises shall comply with national industrial policies and local planning requirements and shall ensure that production facilities, storage facilities, equipment and operating processes meet applicable safety requirements.

Construction projects involving the use of hazardous chemicals shall be designed and constructed by entities possessing the qualifications prescribed by the state. Hazardous chemicals processes and equipment under key supervision shall be equipped with the required automated control systems, emergency shutdown systems and related safety protection facilities.

The enterprise shall establish a production safety management system, assign full-time safety management personnel in accordance with the law, and ensure that relevant personnel have completed required training and obtained the necessary qualifications.

The enterprise shall establish production safety responsibility systems, internal safety management rules and operating procedures, and provide employees with safety education, training and occupational protection measures.

The enterprise shall conduct safety evaluations through qualified institutions, identify and manage major hazard installations in accordance with applicable requirements, and implement corrective actions where necessary.

The enterprise shall establish emergency management mechanisms, prepare and file emergency response plans for hazardous chemicals accidents, organize emergency response personnel and maintain necessary rescue equipment and facilities.

Where enterprises store or use highly hazardous toxic gases, additional protective equipment and emergency response arrangements shall be established in accordance with applicable regulations.

The enterprise shall also satisfy other safe-use conditions prescribed by applicable laws, administrative regulations, national standards and industry standards.

Required materials
1. Application form for the Permit of Safe Use of Hazardous Chemicals;
2. Supporting documents evidencing that the site selection and layout of the newly established enterprise comply with national industrial policies and local government planning requirements at or above county level;
3. Documentation of the production safety responsibility system, together with the list of production safety rules and operating procedures;
4. Documentation evidencing the establishment of a production safety management organization and the appointment of full-time production safety management personnel;
5. Qualification certificates of the principal person in charge, the person responsible for production safety and production safety management personnel, together with operation certificates of special operations personnel;
6. Supporting documents evidencing record filing of the emergency response plan for hazardous chemicals accidents;
7. Safety data sheets and safety labels for the hazardous chemicals used;
8. Copy of the business license or business registration approval documents;
9. Safety evaluation report and report on rectification results;
10. Completion acceptance report for safety facilities of the construction project of the newly established enterprise;
11. List of emergency response organizations, emergency response personnel, and emergency rescue equipment and facilities;
12. Supporting documents evidencing record filing of major hazardous installations (where applicable).
