This guide provides essential information to law firms in Hainan on applying for record filing for the engagement of foreign lawyers as foreign legal advisers.

Basic requirements (for the law firm)
The law firm shall be a partnership law firm established in Hainan province for more than three years, excluding branch offices.

The law firm shall employ more than 20 full-time practicing lawyers.

The law firm shall possess strong capabilities in foreign-related legal services and maintain sound internal management.

The law firm shall have no record of administrative penalties or industry disciplinary sanctions within the preceding three years.

Basic requirements (for the proposed foreign legal adviser)
The individual shall be a natural person who is not a national of the People's Republic of China.

The individual shall have continuously engaged in legal practice outside China for a minimum of two years and shall be currently licensed to practice law.

The individual shall possess strong capabilities in handling legal affairs relating to the lawyer's home jurisdiction and in international legal matters.

The individual shall have no criminal record and shall have no record of administrative penalties or industry disciplinary sanctions arising from violations of professional ethics or practicing disciplines.

The individual shall satisfy the applicable requirements for obtaining a work permit for foreigners in China.

Required materials
1. Application for record filing for the engagement of foreign legal advisers;
2. Basic information form for the proposed foreign legal adviser;
3. Copy of the passport of the proposed foreign lawyer;
4. Letter of undertaking confirming that the law firm has no foreign investments;
5. Copy of the law firm's practicing license;
6. Reports on foreign-related legal services for the preceding three years;
7. Employment contract between the law firm and the foreign lawyer;
8. Supporting documents evidencing that the foreign lawyer has continuously engaged in legal practice outside China for a minimum of two years;
9. Supporting documents evidencing that the foreign lawyer has no criminal record and has not been subject to administrative penalties or industry disciplinary sanctions for violations of professional ethics or practicing disciplines.
