Basic Requirements
1. The project must conform to the development plan, industrial policies and access standards.
2. The project must reasonably develop and effectively utilize resources.
3. The project must not affect national and ecological security.
4. The project must not have a significant adverse impact on public interests.
5. The project must comply with the national provisions on the management of capital projects and foreign debts.
6. Non-prohibited projects with a total investment (including capital increase) of $300 million or more in the Special Administrative Measures for Foreign Investment Access to Pilot Free Trade Zones (Negative List) may be submitted to the National Development and Reform Commission for approval, among which projects with a total investment (including capital increase) of $2 billion or more must be filed with the State Council.
7. Non-prohibited projects with a total investment (including capital increase) of less than $300 million in the negative list shall be approved by the Hainan Provincial Development and Reform Commission.
8. Foreign investment projects that are not covered by the preceding two paragraphs but listed in items 1 to 10 of the Catalogue of Investment Projects Subject to Governmental Approval (2016 edition) shall be approved in accordance with the following provisions: (1) Projects subject to provincial government approval, as stipulated in the catalogue, shall be approved by the Hainan Provincial Development and Reform Commission; (2) Projects subject to local government approval, as stipulated in the catalogue, shall be approved by the development and reform department of the corresponding city/county or the Yangpu Economic Development Zone.
