Basic Requirements
Regulations on Flexible Talent Recruitment in Hainan Province
Article 4: Candidates must satisfy the following fundamental requirements:
(1) Good professional ethics and strong team spirit;
(2) Solid professional knowledge or specialized skills that meet the collaboration needs of employers in Hainan;
(3) Good physical health necessary for providing intellectual services in Hainan, with comprehensive medical, pension, and other social insurance coverage.
(4) Generally not exceeding 65 years of age; exceptions may be made for master-level talent, eminent experts, and critically-needed specialists.
(5) No circumstances that legally prohibit mobility.
(6) For those currently employed, the employer's formal consent to the professional's flexible service arrangements in Hainan.
Article 5: Participating organizations shall fulfill the following conditions:
(1) Be officially registered within Hainan's administrative region.
(2) Possess independent legal entity status with stable operations and sound financial standing.
(3) Have clear needs for intellectual, technical, or project-based cooperation with specific implementation plans.
(4) Be capable of providing market-competitive remuneration and appropriate working and living conditions.
Article 6: Recruiting entities shall strictly comply with relevant laws and regulations and shall promptly sign agreements with the flexibly recruited talent or their full-time employers. These agreements shall clearly specify the rights, responsibilities, and obligations of all parties, including:
(1) Engagement modality, service duration, performance objectives, and related requirements.
(2) Confidentiality and intellectual property protection.
(3) Payment of remuneration and provision of welfare benefits during the engagement period.
(4) Supplemental insurance coverage during the engagement period, including medical care, accidental injury, and other related insurance.
(5) Matters concerning the ownership, use, and transfer of patents and other outcomes created during the engagement period.
